The prosecution had required one year of ineligibility and six months in prison against the two politicians. Justice suspected Mr. Ciot, former associate of Mr. Guerin, having enjoyed a convenience dismissal from the Chairman of the General Council of Bouches-du-Rhône. He had touched 65,000 euros in compensation, after nine years in the office of president of the council.
Jean-David Ciot, now deputy of the Bouches-du-Rhône and current leader of the Socialist Federation of the department, was also acquitted of possession of stolen property. The court found that the offenses were “not characterized.” Jean-Noel Guerini is still under investigation in two other cases of alleged embezzlement of public procurement in the Marseille region.
DECISION “FAIR”
Mr. Guerin has not made any statement on leaving the Marseilles Criminal Court; his lawyers felt that the decision was “just” .
The prosecution had mentioned a “termination aberrant” , questioning in particular on lack of notice of dismissal, which showed in his “intentionality” of the two defendants. Mr. Guerin had admitted decided to dismiss his collaborator unwittingly “at no time (…) thought breaking the law” and not have held the dismissal details.
