Under pressure from the European Court of Human Rights, Francois Hollande has given the green light to the right of professional association for soldiers. He announced Friday the development of a draft law to this effect, but excluding “any union law.”

This decision was taken on the basis of a report submitted to the President after two decisions of the ECHR in early October, which had opened a breach in the ban on French military to organize. It found that France had violated the freedom of military association, by enacting “an outright ban on forming a union or joining.”

Hélène Pilichowski believes that military who defend France have also the right to defend themselves and assert their professional prerogatives. Guillaume Perrault, too, is concerned that this professional association law entails a risk of disorder in the army. He mentioned the case of magistrates who, having obtained the right to organize in June 1968 began to impose on the political stage by creating the Union of Magistrates.



When judges have the right to professional associations, they passed a defense of categorical interest in a political process.
