Lionel Jospin integrates Tuesday, taking an oath, the Constitutional Council, one of the most prestigious institutions of the Republic, becoming illico by his rich career and temperament demanding a flagship member.

Former Prime Minister Lionel Jospin is the 73rd Constitutional judge appointed.

Of the current three ex-presidents, ex officio members, only one, Valéry Giscard d’Estaing seat at the Palais Royal.

The one who had trouble with the High Council when he was at Matignon will be the only former head of government among its active members.

Their mission: to judge the conformity of laws with the Constitution, in their quiver with a lightning weapon, censorship. Their role has increased with the reform of July 2008 through QPC (priority question of constitutionality) they can now be typed texts of the past and not just the new laws

The mandate of Lionel Jospin. is four years and two months since it replaces the centrist Jacques Barrot, appointed in 2010 and died suddenly on December 3rd in the Paris metro.

The High Council has five “technicians” (from the Council of State, the court of auditors …) and four “political”. Unchanged relationship, Barrot also being a “political”.

His appointment was published in OJ Tuesday morning, hours before his swearing at the Elysee Palace at 18:00.

A ceremony in closed session, during which the head of state asked the new judge to swear on the Constitution he will fulfill his duties “impartially “keep” the secret deliberations and votes’, will take “no public position.”

A constitutional expert was convinced that Jospin bring much by its height and its views seriously applied, including demonstrated in its written replies to MPs.

A temptation to take precedence over the other? The same dismisses given the strength of an institution, group, very high level.

Prime Minister Jospin had suffered some bitter censures of the institution subsequently presided over by Socialist Roland Dumas, then the Gaullist Yves Guéna, including the status of Corsica with the refusal that regional assembly can adapt laws.
