Lionel Jospin integrates Tuesday, taking an oath, the Constitutional Council, one of the most prestigious institutions of the Republic, becoming illico by his rich career and temperament demanding a flagship member.
Former Prime Minister Lionel Jospin is the 73rd Constitutional judge appointed.
Of the current three ex-presidents, ex officio members, only one, Valéry Giscard d’Estaing seat at the Palais Royal.
The one who had trouble with the High Council when he was at Matignon will be the only former head of government among its active members.
Their mission: to judge the conformity of laws with the Constitution, in their quiver with a lightning weapon, censorship. Their role has increased with the reform of July 2008 through QPC (priority question of constitutionality) they can now be typed texts of the past and not just the new laws
The mandate of Lionel Jospin. is four years and two months since it replaces the centrist Jacques Barrot, appointed in 2010 and died suddenly on December 3rd in the Paris metro.
This is not without possible consequence within an institution whose president – Jean-Louis Debré, faithful Jacques Chirac that had nominated at the end of his five years – will be renewed in March 2016.
For his stature, Lionel Jospin seem doomed to succeed him. But in this case, he should leave the beautiful office of the president of the Royal Palace from 2019 and not in 2025, normal expiry of any person appointed member and chairman in 2016.
Where a risk to the left losing a key position if the Elysee would change hands in the meantime … Computer to which the name of Olivier Schrameck was pronounced (but one who was Jospin’s chief of staff he could not on his ex- boss?), and also that of Laurent Fabius, the eternal enemy brother.
With the arrival of Jospin, the Board has 4 members appointed by the left and five to the right. But among them, President Nicolas Sarkozy chose in 2010 the very Mitterrand Michel Charasse

-.. Impartiality and confidentiality –
The High Council has five “technicians” (from the Council of State, the court of auditors …) and four “political”. Unchanged relationship, Barrot also being a “political”.
The one who was first secretary of the PS, Minister and MP was selected by Claude Bartolone, President of the National Assembly.
Choice validated on December 17 by the Committee on Laws. The rapporteur UMP Guillaume Larrivé had flattering formulas, crediting Jospin “three outstanding qualities: the experience of the state, the personal impartiality, which is a virtue, and probably a fidelity to the classical principles of our Republic” which is useful to a position where you have to “know moderate the heat of the majority of the time,” slipped the opposition MP …
Jospin had said such a move towards negative a Supreme Court and the US had forbidden “to conduct any political campaign” during his term.
His appointment was published in OJ Tuesday morning, hours before his swearing at the Elysee Palace at 18:00.
A ceremony in closed session, during which the head of state asked the new judge to swear on the Constitution he will fulfill his duties “impartially “keep” the secret deliberations and votes’, will take “no public position.”
A constitutional expert was convinced that Jospin bring much by its height and its views seriously applied, including demonstrated in its written replies to MPs.
A temptation to take precedence over the other? The same dismisses given the strength of an institution, group, very high level.
Prime Minister Jospin had suffered some bitter censures of the institution subsequently presided over by Socialist Roland Dumas, then the Gaullist Yves Guéna, including the status of Corsica with the refusal that regional assembly can adapt laws.
He was interrogated her time on a “political” nature of these decisions.
