In a decision of 24 February, the Council of State sweeps the use of trade unions by allowing stores DIY products at retail to waive the rule of Sunday rest.
The State Council has approved the opening of DIY stores on Sunday, authorized by decree In a ruling Tuesday that ends the procedure.
The institution said it had “dismissed the actions brought by several trade unions against two decrees” allowing stores to the DIY products detail depart from the rule of Sunday rest.
It took the view that these texts “meet the conditions of procedural and substantive to which such exemption is subject to Sunday rest.”
These two decrees dated respectively 30 December 2013 and 7 March 2014. But the first who added the businesses in this sector to the list of establishments which may, provisionally, open on Sundays had been suspended by a judge of the Board of State.
The government had therefore taken a new decree to replace the one whose legality was questioned. Unlike the first, the decree of 7 March 2014, did not limit the duration of the exemption.
Various trade unions and federations of the Workers Force and South particular had requested cancellation “ultra vires” the Decree of 7 March 2014.
“In its decision Tuesday, the Council of State ruled definitively on these cases and dismissed the appeals against the two decrees,” said a statement.
