Fake voters: the Supreme Court rejected the appeal of the spouses … – The Obs

Paris (AFP) – Two decades after the facts, the Supreme Court on Tuesday rejected the appeal of the former mayor of Paris Jean Tiberi and his wife Xaviere against their conviction in the case of fake voters fifth arrondissement .

The inseparable husband Tiberi, 80 and 78, immediately reported instructed their lawyer to file an appeal with the European Court of Human Rights (ECHR).

The court also dismissed the appeal brought by Anna Affret, former first assistant of Mr. Tiberi for mayor of the fifth, also convicted in the case.

The prosecution accused them of inciting close the couple, supporters of the RPR (party of Jacques Chirac, the predecessor of Jean Tiberi for mayor of Paris) and other persons not resident in the borough to register on the lists for municipal and legislative elections in 1995, 1997, in exchange a job, a home, a nursery place …

Jean Tiberi was sentenced on appeal in 2013 to ten months suspended sentence, a fine of 10,000 euros and three years of ineligibility, as in the first instance. Mayor of the capital from 1995 to 2001, then it was still mayor of the fifth, but was replaced in the last municipal.

His wife was sentenced, as in 2009, nine months suspended, 5000 euro fine and the Court of Appeal had added two years deprivation of the right to vote.

Mrs Affret was sentenced to eight months imprisonment and a fine of € 1,000.

On appeal, the Advocate General had described Jean Tiberi as the designer of a “massive operation of fraudulent registrations”, the “prime contractors” were his wife and his first assistant.

– Facts ‘always challenged’ –

He still felt that some 6,000 write-offs on the electoral lists after the discovery of the fraud in 1997 reflected the magnitude

.

Jean Tiberi had he sought to minimize the interest he would have had to defraud, arguing comfortable re-election and stressing that justice was seized “only” 198 fake voters.

But the Court of Appeal had considered the “primary beneficiary” of fraudulent registrations on the electoral roll device to ensure it “easy election likely to promote his political ambitions in the city” .

The highest court in the country do not ordered to retry the case on the merits, ruling solely on the correct application of the law by the appellate court.

Mr. Tiberi has once again dismissed the charges against him after the announcement of the judgment of the Court of Cassation. “I have always challenged the charges against me, remembering that I have never been questioned by any witness, by any voter, and thus, the record contains no physical evidence implicating me,” he assured the former elected official.

And to ensure he had “never, in any way whatsoever involved in the case known as voter election of the fifth arrondissement of Paris.”

Environmentalists elected to the board of Paris, including Yves Contassot who was a civil party in the case, Mr. Tiberi wanted to “apologize”.
