Intelligence Act, the Senate vote the draft by modifying – Le Point

The Senate voted Tuesday by modifying the highly contested bill on intelligence, presented by the Government name of countering terrorism. 251 senators, mostly right but on the left, voted in favor, 68 against, and the rest abstained. The text, for which the government requested the emergency procedure (a reading room), was passed in May by a large majority of MPs PS, UMP and UDI. A joint committee (7 MPs, senators 7) must now find a common version to both chambers.

The Senate set including “a true specification”, in the words of rapporteur Philippe Bas ( The Republicans), legality intelligence techniques, controlled by the National Control Commission technical intelligence (CNCTR) and the State Council. Licensing procedures have been strengthened and retention periods of data were supervised. Eg the connection data may be kept three years and not five.



Communications

CNCTR becomes his side “a true independent administrative authority”, says Bas. The Senate also adopted a proposal for organic law that will allow the president to be appointed after consultation with the relevant parliamentary committees. A crime of obstruction of missions CNCTR was created. Three of the nine members of the CNCTR will enter the Council of State.

The Senate also supervised the use of algorithms to analyze communications exchanged within the network of an operator. As for persons in the entourage of people supervised, they may not be the target of the intelligence techniques after the express opinion of the plenary session of the CNCTR.
