The state of emergency, it will last – Le Parisien

Philippe Martinat | |. Update:

ON ALMOST HAD FORGOTTEN, because of the turmoil on the deprivation of nationality: the state of emergency decreed after the events of November 13, scheduled to end on February 26. But after ? Yesterday, Francois Hollande cut short the questions indicating to the Presidents of the Assembly and Senate, Gerard Larcher and Claude Bartolone, that the extension of the state of emergency seemed “quite likely”.

The topic has been discussed since logically maintenance at the Elysee was about the draft constitutional revision which precisely aims to enter a state of emergency in the fundamental text of the V th Republic. This system strengthens police powers, allowing the house arrest, administrative searches day and night or prohibition of gatherings, all without control of the judicial judge.

Yesterday, the League of Human Rights (LDH) announced entering the State Council to stop, totally or in part, to the binding measures of the state of emergency. According to her, these measures are no longer justified and carry “grave and manifest infringement of civil liberties.” The highest administrative court next Tuesday will consider an application for interim measures in that freedom.

In this case, it is however not the intervention of LDH concern power. “Apart from restricted networks, it does not feel up to the country a battle against the state of emergency, it is even quite the opposite,” notes a Socialist deputy. But while the extension of the state of emergency had been passed to virtually unanimously by Parliament on 19 and 20 November, its becoming problematic. Difficult for a democracy to live forever under such a system, but how to get out?

The President PS of the Committee on Laws of the Assembly, Jean-Jacques Urvoas, had himself felt that the interest of the state of emergency was fading as the main objectives have been achieved. But he also noted that out of this state of emergency would be “a difficult act to take.” “This is a political and not a legal issue, decrypts an elected majority. If we decide to leave the state of emergency and a terrorism wave comes it will be too easy to tax us naively optimistic or irresponsibility. “

Meanwhile, Parliament will vote ‘before February 26,” an extension of the state of emergency. In the entourage of the President of the Assembly, it looks for an extension of three months in three months that will allow the Parliament to continue to exercise control over this device. At least until the final of the football Euro planned July 10 at the Stade de France.
