The labor inspectorate refused to allow the dismissal of a staff representative (CGT) accused the company of having assaulted two guards and HRD Xavier Broseta October 5, 2015, according to a decision consulted by AFP Thursday. Air France “will immediately form a hierarchical appeal to the Ministry of Labour,” said in the wake a spokesman of the group.

In its decision, the labor inspection indicates that the “facts invoked as a whole does not establish the existence of gross negligence by the employee, characterizing his malice vis-à-vis the company. ” The delegate was accused by management of having “pushed and shoved another employee” in the direction of HRD. But labor inspection, “it is impossible to determine with certainty” if it “upsets employees voluntarily, or is itself heckled.”

The appeal has no suspensive effect, the company must reinstate the employee of Air France Industries (maintenance) and pay him the wages not received since its conservatory layoff without pronounced balance October 16, said Mehdi Kemoune, legal officer of the CGT Air France. According to the Labor Code, “if the dismissal is refused, the layoff is canceled and deleted effects of right”. Four other Air France employees were fired. With the CGT, they will be judged on May 27 at the Bobigny Criminal Court for violence.

Driven by favorable economic conditions and positive results, Air France introduced Friday a new draft providing for an increase of the fleet and potential hires, burying what was called the “Plan B”. In fact, management does not give up the first phase of “Plan B” (1000 job cuts and 5 had less in 2016), but the second, more painful on industrial aspects (withdrawal of nine aircraft) and human (2 000 job cuts). Fine tuning fault in September 2015, Air France had abandoned its original growth plan, “Perform 2020″. The announcement of a “Plan B” had angered trade unions and a strong mobilization of employees.
